　　原来这部电影还是在宣扬美国人最自豪的两样东西：纽约，和爵士乐。

　　纽约，代表了自由。

　　在一项规定的肯定和否定行为之间，往往存在着一定的空隙，就是所谓的自由裁量权。这样的自由裁量权，除了对那些职位工作要求严谨和死板的行政人员来说是有弊的之外，对其它每一个岗位上的行政人员都是必要的。因为在行政工作中，对于变化的社会中出现的种种状况，某些制度规定的还不甚详细，或者不可能尽其可能性地作相应规定。因此，如何高效率地处理行政事务，就有赖于行政人员的自由裁量权的发挥。而对于这些行政人员来说，如何恰当地使用自由裁量权，很大程度上来自于其自身的职业道德修养。而不管行政人员的职业道德修养是否到位，行政人员在履行职权时，都会出现一定的偏转，我们称之为自由裁量权的使用(如上图所示)。自由裁量权既可能偏向行政人员自身，也可能偏向于社会中的其他利益集团，关键在于受到来自哪方面的拉力。在这一过程中，也很容易像弗兰克一样，将个人恩怨(即个人感性因素)注入其中。当个人的感性因素并没有到达职权规定的范围，而是存在于自由裁量权的范围内时，我们一般认为，行政人员的行政行为是合乎规定的。至于是否合乎道德，则应根据具体的行为和情况而定。而如果行政人员的行政行为，受到来自社会集团或者公共利益的拉力比较大，其自由裁量权就可能外偏。但是无论内偏还是外偏，都有一定的度，一旦突破，就称之为权利谋私或者为特定利益集团服务，构成了职权的违规使用。

　　依照这个不怎么完备的框架，我们可以对影片中个人的行为进行衡量。在影片中，无论是逼迫维克多进入美国，还是阻止维克多进入美国，虽然目的都不一样，但是弗兰克却守着自己的职业规定的底线没有冲破。我们应该注意到，弗兰克对机场的规章制度很了解。他在诱导维克多进入美国的过程中，只是利用制度的漏洞，暗示维克多说“美国在这五分钟内是开启的”，而并没有利用职权，也没有违反其任何的职业规定，都是在规定的制度范围内进行操作。这也包括在后来他在阻止维克多进入美国的过程中，他也只是利用了制度给予自己的审批权，加上审批权背后的自由裁量权，这也和任何的制度不相冲突。而在维克多闯关成功，进入美国之后，在面对警卫“是否要封锁住南面的出口，并检查每一辆汽车”的问题时，他的回答也是否定的。因为超出机场候机大厅的地方，并不是他职权的有效范围。可见，他并没有被自己的私人恩怨所支配，其个人感性因素并没有冲破边界，仍旧以对自身职位的规定为行为准则。因此，说弗兰克权利谋私，是根本站不住脚的。

　　那么，弗兰克既然没有权利谋私，他的行为又究竟在那里出问题了呢?在我看来，问题出现在其行政态度上，或者说是情感层面上的人文关怀，但是绝非道德。道德这个东西，每个人从自己的角度看，都会有不同的解读，有时还会出现道德困境。比如说，当机场里出现一个穿着睡衣的男子到处晃荡的时候，弗兰克选择了诱使和逼迫其离开。这样的行为虽然没有违反相关规定，但是对于机场的管理，乃至于维克多本人的希求来说，这都是好的、道德的。但是，这样的做法对于美国国民和国家安全来说，却缺乏道德的支撑。

　　那么，对于一位行政人员来说，怎样平衡专业能力、道德与个人情感才算是恰当的呢?在我看来，所谓的道德和个人情感，可以融入到行政态度这一概念中，因为他们都属于行政人员在行政管理过程中，对某些事物或工作的主观评价和行为倾向。而就行政态度、专业能力与不同职位对行政人员的要求三者之间的关系，在漫长的西方管理思想史中，我们可以借用布莱克和莫顿的著名的管理方格理论模型，将其中的两个变量代之以“专业能力”和“行政态度”，从而可以得出上图。与管理方格理论中的两个测量维度——纵轴“对人的关心”和横轴“对生产的关心”——相似的是，纵轴“专业能力”代表对工作的关心，或者是工作的专业化程度;横轴“行政态度”则代表对行政相对人的关心。将不同的区域作划分的依据是：不同的行政职位对行政人员的专业能力和行政态度的要求是不同的。特别要说明的是，很多行政组织中并不存在诸如“低效执行者”的相关职位，但是也不排除一些行政组织中设置一定的闲职，提供给那些即将退休的低级行政人员，因此在无论是专业能力还是行政态度方面，对他们的要求都非常低。当然，这是少数行政组织中的特例。就一般而言，一个行政组织中会大量的存在图中所表示的另八种职位。这些职位在晋升的过程中，并没有固定的次序。

However, in my opinion, Frank has not made any mistakes, he has always followed the rules of his profession.

　　At the beginning of the film, Frank shows everyone that he is a professional. Such a talent display, but also let all people are sure that he is suitable for this work. After that, however, controversy ensued as the plot unfolded. After seeing the measures Frank takes to force Victor to leave the airport, many people conclude that Frank is in power for personal gain and that his behavior violates the requirements of his profession. But is this really the case?

　　In his book Political Order in a Changing Society, Huntington said, "The public interest is neither something inherent in the laws of nature nor in the will of the people, nor is it any kind of result of political processes; the public interest is the interest of public institutions." For in administrative work, certain systems do not yet provide for the conditions which arise in a changing society in great detail, or it is not possible to provide for them to the extent possible. For these administrators, how to use their discretion properly largely comes from their own professional ethics. Regardless of whether the administrative staffs professional ethics are in place, there will be a certain deflection when the administrative staff performs their functions and powers, which is called the use of discretion (as shown in the figure above). The discretionary power may be biased towards the executive himself or other interest groups in the society, the key is from which side the pull. In this process, it is also easy to inject personal grudges (that is, personal emotional factors) into it, as Frank did. When personal emotional factors do not reach the scope of authority, but exist in the scope of discretion, we generally believe that the administrative act of the executive is in line with the regulation. As to whether it is ethical or not, it should depend on the specific behavior and situation. However, if the administrative actions of administrative personnel are strongly influenced by social groups or public interests, their discretionary power may be biased. However, whether it is internal or external bias, there is a certain degree, once it is broken, it is called power peddling or serving for specific interest groups, which constitutes the illegal use of power.

　　According to this incomplete framework, we can measure the behavior of individuals in the film. In the film, whether it is forcing Victor to enter the United States or preventing Victor from entering the United States, although the purpose is different, Frank has not broken the bottom line of his professional regulations. 　　Franks lack of human care, as well as the moral conflicts mentioned earlier, are shown in the film through one incident, the Russian drug incident. From the initial fierce reaction of the Russians, we can counter-infer that Frank made a great mistake in his initial communication with the Russians. We can see it in the subsequent communication between Victor and the Russian. When the Russians noticed Victors gentle tone and patient attitude, his words and deeds were immediately softened. So it was Frank and his administrations lack of human care that ultimately led to the anger and petulance of Russians. Because of this, personal emotional factors will break through the boundary, constitute qualitative interference with the form of authority, and thus make the provisions of authority face challenges. Once the challenge is successful, the terms of reference will henceforth lack the necessary binding force on the actions of the executive, resulting in greater and inevitable ethical dilemmas. Even leaving this aspect aside, Victors actions are in conflict on a moral level. From the point of view of the Russians and the airport staff, Victor is clearly a messenger of justice, an embodiment of morality, because he may have saved a dying life. But from another aspect, that is, airport supervisors and immigration management, and even national security, Victors behavior is obviously a bad exception for their supervision, such a demonstration role if carried on, will directly threaten the order and security of immigration, and eventually lead to the collapse of the airport management system. 　　So, what is the proper balance between professional competence, ethics and personal emotion for an executive? In my opinion, the so-called moral and personal emotions can be integrated into the concept of administrative attitude, because they belong to the subjective evaluation and behavioral tendency of administrative personnel towards certain things or work in the process of administrative management. In the long history of western management thought, we can borrow the famous management grid theoretical model of Black and Morton and replace the two variables with "professional ability" and "administrative attitude" to get the relationship among administrative attitude, professional ability and administrative attitude.
